These Terms of Use ("Terms") govern your access to and use of the website at theequalaccess.com, our recruiting and consulting services, and our internal employee portal and related tools (together, the "Services"), provided by EqualAccess (operated by EqualAccess Talent, LLC, "EqualAccess," "we," "us"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
EqualAccess provides talent and management consulting, including executive search, recruiting, operations consulting, and leadership development. Our website presents information about these offerings. Our internal portal and tools are provided for use by authorized EqualAccess personnel and approved clients and partners in support of active work.
We grant you a limited, non-exclusive, non-transferable, revocable right to use the Services for their intended business purpose. You agree not to:
Access to the internal portal is restricted to approved accounts. If you are given access, you are responsible for keeping your login credentials secure and for activity that occurs under your account. We may suspend or revoke access at any time, including to protect the security of the Services.
The Services, including their content, design, and software, are owned by EqualAccess or its licensors and are protected by intellectual property laws. Except for the limited use rights granted here, no rights are transferred to you.
The Services may connect to or rely on third-party platforms, including Intuit QuickBooks for accounting. Your and our use of those platforms is also governed by their respective terms and policies. We are not responsible for third-party services, and connecting them is at our discretion as the account owner.
The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.
To the fullest extent permitted by law, EqualAccess will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed one hundred US dollars (USD 100) or the amount you paid us for the relevant Service in the prior twelve months, whichever is greater.
You agree to indemnify and hold EqualAccess harmless from claims, losses, and expenses arising out of your misuse of the Services or your violation of these Terms.
These Terms are governed by the laws of the State of New York, without regard to its conflict of laws rules. Any dispute will be resolved in the state or federal courts located in New York County, New York.
We may update these Terms from time to time. When we do, we will revise the effective date above and post the updated version on this page. Continued use of the Services after changes means you accept the updated Terms.
